We provide you with these terms and conditions ("Terms") which contain information regarding the general use of the EmotiAI service ("EmotiAI" or the "Service"), including information you may need or be curious about while using the Service. Through these Terms, you can find information regarding your rights, responsibilities, and other details concerning EmotiAI Corporation ("we" or "Company") and you ("you" or "Members"). These Terms are posted on the Service for easy accessibility at any time. The Company will make its best efforts to continuously provide you with reliable services, and we hope the following information will help make the Service more accessible to you.
The Company will upload these Terms on the Service or the connection page. These Terms may be amended in compliance with applicable laws. When the Company amends these Terms, it will provide at least 7 days' prior notice, which will include the reasons for amendment and the effective date. However, if the amendment could potentially impact you adversely, notification will be provided through the Service at least 30 days in advance, and you may be individually informed through emails or other communication means.
If you do not expressly refuse the proposed changes after the Company has notified you of intended amendments to these Terms, the Company shall consider this as consent to the amended Terms. If you refuse to consent to the amended Terms, the Company will be unable to apply the amended Terms, and you may terminate the service usage agreement. However, if there are special circumstances where the Company cannot apply the unamended Terms, the Company may terminate the service usage agreement. Even if any portion of these Terms is determined to be inapplicable, the remainder shall continue to be effective.
The Company may establish additional agreements or operation policies ("Operation Policy") for individual services. Any items or interpretations not mentioned in this service usage agreement shall be decided according to separate operation policies, relevant legislation, or customary practices.
The service usage agreement is executed when an applicant (the "Applicant") agrees to these Terms, applies to become a member, and the Company accepts this application. The Company will generally accept applications to use the Service. However, there are circumstances where the Company may refuse the application or cancel the service usage agreement after confirming the application. Firstly, if the Applicant previously lost membership status, the Company may refuse the application, unless the applicant has received permission for re-application from the Company. Secondly, if the Applicant provides false information or fails to supply requested information, the Company may refuse the application. Thirdly, the application may be rejected due to causes attributable to the Applicant or if the applicant violated any prior rules and regulations. Additionally, individuals under the age of 16 may not use the Services provided by EmotiAI, and this restriction also applies to EmotiAI-related services. Furthermore, if the Company lacks sufficient service-related equipment or faces technical or business-related challenges, acceptance of applications may be delayed.
If your application is refused or delayed for the aforementioned reasons, the Company will notify you in principle. The service usage agreement shall enter into effect when the Company accepts and notifies acceptance of the application. The Company may offer tiered access to its Services (including restrictions on time, frequency of use, and service menus) based on the Operation Policy.
The capitalized terms used in these Terms have the meanings set forth below:
"Service" refers to EmotiAI and EmotiAI-related services accessible across various devices (including but not limited to computers, televisions, mobile devices, and other wired or wireless devices).
"you" or "Members" refers to customers accessing and using the Service who have entered into a service usage agreement in accordance with these Terms.
"Content" refers to any text, photos, videos, files, links, or other materials that you post on the Service in the form of symbols, letters, voice notes, sounds, images, or videos.
You may access and edit your personal information through the profile settings at any time. You should update your profile if any information provided at the time of application changes. The Company is not responsible for any disadvantages resulting from failure to do so.
The Company owns, holds, and reserves the copyright and other intellectual property rights to the Service, except for Content created by you. The designs, text, scripts, graphics, code, illustrations, icons, photos, videos, interpersonal transmission services provided by the Company, and all related logos, service marks, and trademarks are either owned by the Company or licensed under relevant legislation.
The Company grants Members the right to use the Service in accordance with the terms and conditions set by the Company. You may not dispose of the Service or the rights granted hereunder through transfer, sale, or offering as security. You are granted rights solely to use the Service per these Terms; no other rights, including ownership or copyright to the Service, are granted. Your use of the Service must be limited to accessing information or personal use.
Unless specifically stated in these Terms of Use, you may not copy or distribute text, scripts, or graphics created by the Company, including using, copying, or circulating member status information accessed through the Service for profit. Unless you have explicit written permission from the Company, you may not extract source code, decompile, or create derivative products related to the Service or its software.
The Company believes that Content you distribute through our Service can enhance and enrich experiences. Content includes any posts or files—such as symbols, letters, voice notes, videos, sounds, photos, drawings, or links—that you upload to share with yourself or others.
The Company promises to handle all Content expressing your thoughts and emotions with care. Intellectual property rights to Content you create remain with you.
To lawfully provide Content you upload through the Service, the Company requires a worldwide, perpetual, royalty-free license, including rights to store, copy, edit, transmit, display, share, and create derivative works (solely for translation). By submitting or posting Content, you grant the Company these rights and represent that you hold the necessary rights to the Content you post.
The Company may use rights lawfully granted by you for: exposure within the Service; advertising of the Service; operation and improvement of the Service; research and development of new services; compliance with web accessibility requirements and other legal obligations; and search, collection, and linking from external websites.
Content you provide may be used by the Company and its affiliates for research and development to improve existing services and create new ones. The Company will strive to provide more useful services through continuous research and development.
The Company aims to let you easily control your Content and its accessibility by other Members. When you choose to publish posts publicly, you consent to the Company's use of your posts on publicly available forums (e.g., templates) within the Service. You also consent to other users' use (including edited templates via sharing features) of your posts per these Terms. You may delete content or make it private using management features to control accessibility. Alternatively, you may request deletion, privacy settings, or exclusion from search through customer service; however, such actions may be difficult in certain cases.
EmotiAI's AI Services. To use EmotiAI's AI services (including AI-generated content services and other technologies incorporating artificial intelligence algorithms, hereafter "AI Services"), you may submit photos to generate or use the AI Services. You consent that the Company will use your photos to train AI algorithms solely for generating deliverables resulting from your use of the AI Services. However, your photos will be deleted after deliverables are complete. You must not use or submit photos violating these Terms or to which you lack necessary rights. You agree to indemnify, defend, and hold the Company and its affiliates harmless against losses or claims arising from your use of photos in violation of these Terms.
The Company protects your personal information per applicable laws; protection and use are governed by such legislation or privacy policies. However, if a Member shares child pornography, excessive pornographic content, or content deemed a threat to life, the Company may provide relevant information to authorities regardless of privacy policies. Additionally, the Company may access your Content to confirm compliance with legislation or the service usage agreement and may provide post or chat content to authorities to abide by relevant laws.
If you do not access the Service for an extended period (e.g., no login or access history), the Company may notify you via electronic means (email, in-service notifications) and either destroy your information or store it separately. If you still fail to access the Services, the Company may cancel the service usage agreement.
The Company's privacy policy does not apply to other websites linked from the Service.
When the Company decides to inform you of important information, it shall do so via means it deems acceptable, unless otherwise stated in these Terms.
If the Company deems your complaints or opinions regarding Service use justified, it will strive to address them. You will be informed of the process through customer service or other appropriate means.
To promote proper use of our Services, the following actions are strictly prohibited: providing false information during application or editing personal information; using others' information without permission; collecting, sharing, or providing personal information, registration information, or access histories of other Members; compromising account security by allowing others to access your account; circulating false information for personal gain or to harm others; using the Service to promote inappropriate relationships; and using the Service to criticize or defame others.
Using the Service for profit without Company permission and altering Company-provided information are prohibited. Impersonation, illegal use of others' or the Company's name, violation of copyright and intellectual property rights, defamation, or actions causing work disturbances are also prohibited. Transmitting or posting unauthorized information (including computer programs), posting violent messages, videos, sounds, or other socially inappropriate content, or sharing false information or impersonating others are strictly prohibited.
Actions condoning or promoting the above are also prohibited. You shall abide by relevant legislation, these Terms, Operation Policies, Service use information, instructions, and other announcements. Furthermore, you may not commit actions that may disturb the Company's business or Service operation.

Children and young adults represent our future and deserve societal protection. To help them develop proper values and grow into healthy members of society, the Company will strive to provide a safe environment.
Actions relating to facilitating/promoting sexual services or activities, threats of sharing private images/videos, or standard pornography involving minors will be treated as child exploitation content. Even content shared to raise awareness of child sexual abuse, if explicit, may be deemed as such.
If the Company discovers pornographic content involving a minor, it shall take immediate action. Furthermore, the Company will impose maximum disciplinary measures available on the Service against the Member who uploaded such Content and cooperate with authorities, including providing relevant information.
The Company will accept reports regarding child exploitation content and strive to protect minors from such threats. Please refer to the child protection section within EmotiAI for details.
EmotiAI may offer subscription-based services that provide access to premium features. Subscriptions are billed on a recurring basis through the Google Play Store and renew automatically unless canceled before the end of the current billing period.
Certain features or virtual items may be offered as one-time purchases. Such purchases are consumed immediately upon delivery and are non-transferable.
All payments, including subscriptions and one-time purchases, are processed by Google Play and are subject to Google Play's refund policies. EmotiAI does not independently issue refunds unless required by applicable law.
The Company provides its Service comprising EmotiAI and associated services developed by the Company or partners. Although the Service is intended to be available 24/7, the Company may offer tiered access based on identity confirmation, provision of registration information, or other conditions.
The Company may temporarily suspend Services for reasons such as inspection, maintenance, equipment exchange/breakdown, network connection loss, or operational issues. In such cases, the Company will notify you in advance via acceptable means, except where justified reasons prevent prior notice. The Company may conduct regular maintenance for improved Service provision, with service hours notified through the Service.
Although the Company promises to handle your Content with care, it does not monitor all Content. If your Content is deemed inappropriate per applicable laws (e.g., information network laws, copyright law), regulations, these Terms, the Operation Policy, or unsuitable for the Service, the Company may delete or restrict sharing of such Content.
Please refrain from sharing Content or messages (including comments) that others may find unwelcome, particularly distressing content. Use the Service legally; any illegal use is strictly prohibited.
If your Content contains illegal information per relevant legislation, rights-holders may request takedown, and the Company will act per applicable laws. Even without a specific request, if Content is deemed inappropriate or evidences violation, the Company may delete/restrict access or take temporary actions regarding such Content.
If you breach these Terms or hinder normal Service operation, the Company may restrict your use through warning, temporary suspension, or permanent suspension. The Company may impose permanent suspension immediately to prevent abuse, including providing illegal programs, hacking, circulating malicious programs, violating access rights, automated access, abnormal service use, or attempting prohibited methods. Upon permanent suspension, any benefits acquired through Service use shall be extinguished, and the Company will not grant compensation. Details are in the Operation Policy.
If the Company restricts your use or terminates the agreement, it will notify you. You may appeal through Company-provided procedures. If the appeal is justified, suspension will be lifted.
The Company may modify the Service partially or wholly per operational or technical needs. If changes affect content, usage, or availability, the Company will notify you via adequate means beforehand, including reasons for change, content of change, and effective date.
The Company can alter, suspend, or change part or all of free Services per Company policies or operational needs. Unless specified by law, the Company shall not provide compensation for such changes.
The Company is not liable for Service failure due to natural disasters or force majeure events. Additionally, the Company is not responsible for network connection or access difficulties attributable to you, such as device or access media loss.
The Company disclaims warranties on the reliability or accuracy of information/data posted on the Service or transactions conducted through it and shall not be liable for harm caused by such information/data. Furthermore, the Company disclaims responsibility for free Services unless explicitly stated otherwise in applicable law.
You may be required to view advertisements to use the Service, which allows us to provide free Services and fund research for better Services.
The Company may provide necessary Service use information through in-Service notifications. Unless required by applicable laws for transactions or user inquiries, you may restrict these notifications. If the Company sends profit-driven advertisement information via SMS or other transmission devices, it will do so after obtaining your prior consent.
The Company may display Service-related advertisements on its Service page, noticeboards, or websites. You may not alter, restrict, or edit Company-provided posts.
EmotiAI's AI Services utilize external AI technology. Consequently, the Company cannot fully control results or deliverables generated by the AI Services, and these deliverables do not represent our official policy or position on any religion, ethnic group, club, organization, company, individual, or entity. The Company makes reasonable efforts to moderate AI Services deliverables through configurable AI settings, but cannot moderate user content. By agreeing to these Terms and/or purchasing AI Services, you accept this disclaimer and waive claims against the Company due to generated deliverables. If you find deliverables offensive or unacceptable, please contact Customer Center.
You may apply to terminate the service usage agreement via the account deletion function in the Service at any time, and the Company shall process your request per relevant legislation. Upon termination, your data will be deleted and irretrievable, except as stored per the Company's privacy policy and applicable laws.
When you terminate your agreement, identifiable information (e.g., profile photo) registered in your account will be deleted. However, posts saved or scrapped by other members or shared to community notice boards may remain. To delete such posts, you should do so before termination.
